FARM VISIT LIABILITY WAIVER AND RELEASE AGREEMENT

This Orchard Visit Liability Waiver and Release Agreement (“Agreement”) is entered into by the undersigned visitor (“Visitor”) in favor of Jamaica Organic Pimento Orchard otherwise known as Jamaica Organic Allspice, including its owners, officers, employees, agents, contractors, volunteers, insurers, successors, and assigns (collectively, the “Orchard”).
By entering the property located at 3A Peart Place, Nottingham District, Lincoln P.O. Manchester.
Visitors acknowledge and agree to the following terms and conditions.
1. Acknowledgment of Inherent Risks
Visitors understand that entry onto an agricultural property involves inherent and unavoidable risks, including but not limited to:
• Uneven, slippery, or unstable terrain
• Exposure to insects, wildlife, and natural vegetation
• Contact with farm equipment, tools, and machinery
• Falling branches, fruits, or debris
• Weather‑related hazards
• Allergens, dust, and strong natural scents
• Risks associated with walking, climbing, bending, lifting, or participating in orchard activities
Visitors acknowledge that these risks may result in injury, illness, property damage, or death, and voluntarily assume all such risks.
2. Release and Waiver of Liability
To the fullest extent permitted by law, Visitor hereby releases, waives, discharges, and holds harmless the Orchard from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to:

Personal injury, bodily harm, or death

Property damage or loss
-
Accidents or incidents occurring on the orchard premises
-
Exposure to allergens, insects, plants, or environmental conditions
-
Actions or omissions of other visitors
This release applies regardless of whether the alleged harm is caused by negligence of the Orchard or otherwise, except in cases where liability cannot be waived by law.
3. Visitor Responsibilities
Visitor agrees to:

Follow all posted signs, warnings, and staff instructions
-
Supervise minors at all times
-
Remain within designated visitor areas
-
Refrain from touching or operating farm equipment
-
Avoid climbing trees, structures, or fences
-
Wear appropriate footwear and clothing
-
Conduct themselves in a safe and responsible manner
Failure to comply may result in removal from the property without refund.
4. Health, Allergies, and Medical Conditions
Visitors acknowledge and agree that:

The Farm cannot guarantee an allergen‑free environment

Visitors are solely responsible for managing personal medical conditions
-
Visitors are physically capable of participating in orchard activities
-
The Orchard is not responsible for medical emergencies, allergic reactions, or health complications
Visitors assume all risks associated with exposure to environmental allergens, insects, plants, and outdoor conditions.
5. Personal Property
Visitors understand that the Orchard is not responsible for:

Lost, stolen, or damaged personal items
-
Damage to vehicles or belongings left unattended
Visitors enter the property at their own risk.
6. Photography and Media Release
Visitors grant the Orchard permission to capture and use photographs, video, or audio recordings taken during the visit for promotional, educational, or commercial purposes, without compensation, unless Visitors provide written notice opting out prior to entry.
7. Minors
If Visitors are accompanied by minors:

Visitors represent that they are the parent or legal guardian of such minors, or have obtained permission from the parent or guardian

Visitors accept full responsibility for the safety and conduct of all minors in their care

Visitors agree that this Agreement applies equally to all minors accompanying them
8. Indemnification
Visitors agree to indemnify, defend, and hold harmless the Orchard from any claims, damages, liabilities, or expenses (including attorney’s fees) arising out of:

Visitor’s actions or omissions
-
Damage caused by Visitors or minors under their supervision
-
Violations of this Agreement
9. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of Jamaica without regard to conflict‑of‑law principles.

Cancellation & Weather Policy
1. General Policy Overview
Jamaica Organic Pimento Orchard also known as Jamaica Organic Allspice is committed to providing an exceptional and safe, authentic experience rooted in nature, tradition, and wellness. Because our operations depend heavily on seasonal rhythms, agricultural activity, and outdoor conditions, the following policies ensure clarity, fairness, and the safety of all guests and team members.
2. Reservation & Cancellation Policy
Due to the nature of outdoor orchard tours, certain conditions may necessitate changes or cancellations.

Cancellations made 14 days or more before the scheduled visit or experience will receive a full refund or may be rescheduled at no additional cost.

Cancellations made between 7 days prior to the scheduled date are eligible for rescheduling only, subject to availability.

Cancellations made within 2 days of the scheduled visit are non‑refundable due to the preparation, staffing, and resource planning required for each guest experience.

No‑shows or late arrivals that significantly impact the scheduled itinerary are considered non‑refundable.
We reserve the right to cancel or reschedule tours due to unforeseen circumstances, including but not limited to extreme weather, safety concerns, or operational issues. In such cases, affected visitors will be notified promptly and offered a full refund or an alternative tour date.
3. Weather Policy
Weather‑Dependent Experiences.
As an outdoor agricultural environment, the Orchard’s activities are influenced by natural conditions. Guest safety and the protection of our land and trees are our highest priorities.

Experiences may proceed during light rain or mild weather, and guests are encouraged to dress appropriately for outdoor terrain.

In the event of severe weather, including heavy rain, thunderstorms, high winds, or conditions that compromise the safety of our guests or the integrity of the orchard, Jamaica Organic Pimento Orchard also known as Jamaica Organic Allspice Orchard reserves the right to delay, modify, cancel activities, or reschedule to ensure visitor safety for the next available date.
4. Orchard‑Initiated Cancellations
In rare cases where operational, agricultural, or safety considerations require the Orchard to cancel or significantly modify a scheduled experience:

Guests will receive immediate notification,
-
A full refund, and
-
Priority assistance in rescheduling if desired.
Jamaica Organic Allspice Orchard is not responsible for travel, accommodation, or other incidental costs associated with cancellations.
5. Guest Responsibility
To ensure a smooth and enjoyable experience:

Guests must provide accurate contact information for timely updates.

Appropriate footwear and attire are required for walking through natural terrain.
-
Guests should arrive on time to preserve the integrity of the scheduled experience.
6. Acceptance of Policy
By confirming a reservation with Jamaica Organic Pimento Orchard also known as Jamaica Organic Allspice Orchard, guests acknowledge and accept the terms outlined in this Cancellation & Weather Policy.
